Terms & Conditions

The terms and condition in this Agreement (“this Agreement”) shall apply to the Customer and/or any person who purchased the Product from HPlus, our Authorised Dealer and/or our Official Website only. By purchasing the Product, or accessing and using all services and/or facilities provided by HPlus, the Customer confirms the full understanding and acceptance of the terms and condition of this Agreement. If the Customer disagree in any manner and/or form to any of the terms in this Agreement, the Customer may not access, use or enjoy any of the services or facilities provided by HPlus and shall immediately discontinue the use of the services or facilities provided by HPlus. HPlus reserves the right to unilaterally change, modify, add, or remove any terms of this Agreement at any time and the changes and/or amendments shall take effect immediately upon the same are posted and/or published on the Official Website. The Customer shall check the terms and conditions of this Agreement regularly and the continuing usage and/or access of the Official Website and its entailing services and/or facilities following the posting and/or publication of the changes to the terms and conditions of this Agreement shall be deemed an acceptance of those changes. Any non-compliance or breach of any of the term of this Agreement will result in the immediate revocation of the service herein without any notice to the Customer.

Definition

“Account” means the account consisting the username and password of the Customer created at the Official Website to allow the person as Customer to access and rights to view and make purchase of the Product from the Official Website.

“Product” means any goods or product (include services and/or hydrogen water unit marketed under Hi-Bliss brand name) made available for sale by HPlus and/or purchased by the Customer through HPlus, its Authorised Dealer or its Official Website 

“Authorised Dealer” means the person authorised or appointed by HPlus who sells the Product to the Customer

“Customer” means the buyer or purchaser of Product bought or purchased through HPlus, its Authorised Dealer or its OfficialWwebsite

“HPlus” means HPlus Sdn. Bhd. (Company No.1327635-A), a private limited company registered in Malaysia having its place of business at 1, Jalan PPU 3A, Pusat Teknologi Sinar Puchong, 47150 Puchong, Selangor, Malaysia, who is the distributor of IRHydrolife. 

“IRHydrolife” means IRHydrolife Sdn. Bhd. (Company No1323863-M), a private limited company registered in Malaysia having its place of business at Lot 01, Level 3A, Menara TH Uptown No.3, Jalan SS21/39 Damansara Uptown, 47400 Petaling Jaya, Selangor, Malaysia, who owns and carries hyrogen products with the brand name of “Hi-Bliss”.

“Official Website” means www.hiblisshydrogenwater.com

“Order” means the placement of the order by the Customer to purchase Product.

1. ORDER & ACCEPTANCE 

1.1  An Order placed may be rejected or cannot be processed for various reasons, whereupon HPlus shall not in any manner whatsoever be held responsible or liable to any inconvenience, misfortune, loss and/or damages of whatsoever nature whether directly or indirectly that may be suffered by the Customer.

1.2  When required, the Customer may be asked to provide additional verifications or information, including but not limited to phone number, address and such other information before confirmation of the Order.

1.3  HPlus reserves the right to refuse or cancel any Order without assigning any reason whatsoever at any given time, whether or not the Order has been confirmed and regardless of whether the payment for the Order has been made.

1.4  In the event where the purchase price for the Product has been paid and the Order is subsequently cancelled before the delivery not due to any fault, negligence or omission of the Customer, the purchase price less administrative charges levied by the bank, if any (where payment was effected by bank transfer, cheque or credit card) shall be refunded to the Customer.

1.5  Any typographical, clerical or other error or omission in any quotation, invoice or other document or information issued by HPlus shall be subject to correction without any liability on the part of HPlus.

1.6  The Customer’s Order will be deemed completed (“a Completed Order”) upon date of receipt of the Product by the Customer.

1.7  The Customer may cancel an Order being placed prior to the full purchase price being made and the delivery of the Product. All cancellations must be made by telephone, fax or email and must be supported by valid reasons.

1.8  Where in the transit of delivery, the Goods are subject to any payment of customs, duties, taxes, penalties, costs or any other chargers as required by any local or foreign authorities for the purposes of its clearance or otherwise, as the case may, be shall be borne by the Customer.

1.9  All services to the Product will be provided by HPlus to the Customer at HPlus’s Headquarter or assigned offices. If so requested by the Customer, HPlus may collect the Product from the Customer and return the Product upon servicing the same however subject to such transportation fees as may be imposed.

2. ACCOUNT CREATION

2.1  In the event the Customer is purchasing the Product via our Official Website, the Customer must login to the Official Website with an existing Account or to create a new Account with a username and password to effectively view and make purchase of Product on the Official Website. 

2.2  In the creation of the Account, the Customer must supply name, identity card number/ passport number, address, phone number, email address, bank account information for payment in the relevant electronic registration forms. The Customer will be required to reproduce these details when completing any orders and/or purchases, or for a confirmation of delivery. 

2.3  The Customer is under full obligation and responsibility to provide accurate, current and complete information, and to update such information in a timely manner to maintain its accuracy and completeness. 

2.4  HPlus shall not in any manner whatsoever be responsible or liable to the Customer for any loss and damages suffered by the Customer as a result of any use of the Account save and except due to the gross negligence or fault of HPlus.  

2.5  In the event that any of the information provided or supplied by the Customer to HPlus is found to be not true, not clear or not accurate the Account and any rights or privileges in ancillary thereto towards the sale of the Product, as well as other facilities and/or services accorded may be suspended indefinitely or terminated as HPlus sees fit.

2.6  The Customer must be of minimum age of 18 years at the time of creation of Account

2.7  At all times HPlus reserves the right to monitor all activities of the Account. 

3. PRICING POLICY

3.1  The price of the Product and/or services shall be stated on the Official Website. 

3.2  If HPlus discovers an error in the price of the Product that the Customer has ordered, HPlus will endeavour contact the Customer as soon as possible. The Customer will have the option to reconfirm the Customer’s Order at the correct price or cancel the Order. 

3.3  HPlus reserves the right to change the price of the Product at any time before delivery of the Product in the event of any increase in the expenses or incidental cost of the Product which may due to any reasons whatsoever beyond the control of HPlus. For example, foreign exchange fluctuation, currency regulation, alteration of import or other duties, increases in labour, materials or other manufacturing costs, changes in delivery dates, quantities or specifications for the Product requested by the Customer or any delay caused by any information or instructions given by the Customer or failure by the Customer to provide HPlus with any adequate information or instructions.

3.4  HPlus may at its sole discretion offers additional discounts / promotion for the purchases on the Official Website from time to time that does not apply to the purchase from the Authorised Dealer or vice versa.

3.5  HPlus or its appointed technician/agents shall install or assemble the Product at no additional charges, if applicable. HPlus shall notify the Customer if any additional accessory is needed on the Product. Such additional costs and expenses on the installation of the additional accessory or the services shall be borne by the Customer.

3.6  HPlus does not accept any liability for any price discrepancy for the purchase that the Customer purchased from the Authorised Dealers.

3.7  The price of the Product is excluded of delivery fees in which the same is stated in Clause 5 hereinbelow.

4. TERMS OF PAYMENT

4.1 Payment for the Order and purchases of Product and for all other payment arising shall be directed to HPlus as follow:-

4.2  All payments shall be made in the currency of the Malaysian Ringgit only unless otherwise stipulated.

4.3  All Order shall only be processed and/or confirmed after full payment of the purchase price of the Product has been received by HPlus. For avoidance of doubt, if the purchase price is not honoured or received by HPlus within seven (7) working days from the date of payment, the Order will be deemed void and cancelled without incurring any liability or expenses by HPlus.

4.4  The payment gateway services may be provided by a third party company or services at the sole discretion determined by HPlus from time to time.

4.5 The mode of payments available include:

(a) Credit Card / Debit Cards

(i) HPlus accepts all Visa and Master Cards, both Credit and Debit, and is 3D Secured (Verified by Visa, and MasterCard Secure) enabled. All credit card information are protected by means of industry-leading encryption standards.

(ii) Additional charges may be incurred due to foreign exchange and/or administrative charges charged by the issuing bank.

(b) Online Banking

(i) Telegraphic transfer of payments to HPlus’s bank account. 

(ii) Online bank transfers from any banks wherever situated in Malaysia.

(c) Cheque

(i) In the event the cheque is dishonoured, it shall be deemed that the full payment has not been made by the Customer. 

(d) Instalment Payments via Credit Card

(i) Where applicable, the Customer is entitled to participate in the instalment scheme with our specified banks for a duration of maximum of twenty four (24) months or such duration as HPlus may grant at its discretion. 

(ii) Each credit card instalment scheme may be charged a processing fee as may be determined by the relevant Credit Card company. This fee shall not be refundable, even if the purchase transaction is terminated, regardless of the reason of termination.

(iii) If the Customer decides to cancel an Order prior to delivery, HPlus shall be entitled to impose processing fee as administrative fees, in addition to the transaction fees charged by the Credit Card company. The balance after deduction of the administrative fees and the transaction fees will be refunded to the Customer.

(iv) In the event of cancellation of Credit Card account, any unpaid portion of a purchase price or for any other payments required to be made shall become immediately due and payable. Insofar as is possible, this outstanding sum shall be debited to the Credit Card without further reference to the Customer.

4.6  HPlus reserves the right to charge the Customer a fee for the administrative, packing and delivery costs incurred by HPlus in processing, preparing and delivering the Customer’s Order, refund (if applicable) or exchange.

4. TERMS OF PAYMENT

4.6  HPlus reserves the right to charge the Customer a fee for the administrative, packing and delivery costs incurred by HPlus in processing, preparing and delivering the Customer’s Order, refund (if applicable) or exchange.

5. DELIVERY

5.1  The Customer may choose any of the following delivery options:

(a) Self-collection (applicable for the purchase in Malaysia only)

(i) The Customer may collect the Product at HPlus Headquarter at 1, Jln PPU 3A, Pusat Teknologi Sinar Puchong, 47150 Puchong, Selangor or any assigned regional office (Office Hour: Monday – Friday (9am – 6pm), close on weekend & public holiday)

(ii) Customer is required to present his / her Identity Card, Order confirmation and proof of payment at the time of collection.

(b) Shipping or delivery service 

(i) Product shall be delivered to the specified address as specified in the Order, provided always that HPlus shall be at liberty to delegate all or any of its obligations for the delivery of the Product to any other party as it may from time to time decide without giving any notice of the same to the Customer.

(ii) Free delivery charges is only applicable to the delivery within Klang Valley (the territory of Kuala Lumpur, Selangor and Putrajaya) and state of Penang.

(iii) Other regions will be subject to delivery charges as may be decided by HPlus from time to time.

5.2  The Product will be delivered to the Customer after full payment has been received by HPlus.

5.3  The Customer’s Order will be deemed to be delivered after the delivery order is duly acknowledged by the Customer, which will be the proof of delivery by HPlus of the Product specified therein.

5.4  If the Customer fails to give HPlus adequate delivery information and instructions when placing the Order or if the Customer fails to take delivery of the Product within 3 days, HPlus reserves the right to store the Product until HPlus was given such information by the Customer. Additional costs may be levied on the Customer for further delivery regardless the regions of the Customer’s address.

5.5  Official receipts will be issued together with delivery order upon self-collection or delivery via authorised couriers’ companies. 

5.6  HPlus shall not in any manner liable or responsible for any loss of Product during the delivery of same to the Customer.

6. PERSONAL INFORMATION/ PERSONAL DATA

6.1 When the Customer purchases the Product via HPlus’s Authorised Dealers or Official Website, the Customer is required to provide HPlus with his / her personal details. These personal details are required for HPlus to manage and process and track the Customer’s purchase or share information with IRHydrolife or to receive notice/updates in digital form. 

6.2 Please also refer to HPlus’s Privacy Policy for information relating to the collection, storage, use and protection of the Customer’s personal information by HPlus:

(a) HPlus Privacy Statement which can be found at https://hplus.com.my/ which will form an intergral part of this Agreement (“Privacy Statement”).

(b) By submitting the Customer’s personal information to HPlus and/or by registering an account with HPlus, Customer acknowledges that Customer has read and understood the Privacy Statement and agrees to the processing of Customer’s personal data as set out in the Privacy Statement.

(c) HPlus may update the Privacy Statement from time to time and may use reasonable effort to bring any significant changes to the Privacy Statement to Customer’s attention.

7. EXCHANGE AND RETURN

7.1  Subject to Clause 9 hereinbelow, all Product sold are non-refundable. 

7.2  Notwithstanding to Clause 7.1, the Product purchased from HPlus, its Authorised Dealer or the Official Website by the Customer and shipped from and by HPlus are eligible for exchange for wrong delivery or defective Product provided always that the same is reported to HPlus customer service at +603 3000 8733 within 3 days of the receipt of the Product subject to terms and conditions as set out in Clauses 7.3 to 7.8 hereinbelow.

7.3  Where the Customer is eligible for a remedy by reason of defects of the purchased Product and rectification or repair is possible and available as a remedy from HPlus, the only remedy shall lie in the rectification or repair of the purchased Product. 

7.4  Where Product is not rectifiable and/or reparable or at the discretion of HPlus, the Customer will be entitled to a replacement of the Product or other equivalent.

7.5  Any Customer sought for an exchange must be returned the Product to HPlus in its original condition within 7 days of the receipt of the Product by the Customer subject to the following:

(a) the purchased Product must be returned at Customer’s own expense in its original condition together with all the original packaging, accessories, label and security seal (if any), certificates of authenticity, appraisal & grading, retail box, manuals, booklets, warranty cards, cables, any loose pieces, any accompanying documentations and all other items originally included together with the package of the Product, the sales invoice, the date of purchase and serial number remain intact; 

(b) If the Product is defective or damaged upon receipt by the Customer not due or result of any mishandling, negligence or fault of the Customer or any person from the Customer, the Customer may return the Product by personal delivery to HPlus office located at 1, Jalan PPU 3A, Pusat Teknologi Sinar Puchong, 47150 Puchong, Selangor, Malaysia; 

(c) The Customer shall be responsible for any loss or damage during the shipment.

(d) Where any purchased Product delivered in a sealed packaging or has security seals, the act of opening and/or breaking of such seals, or otherwise in tampering or damaging packaging of the Product, or by removing any labels attached thereof in any manner whatsoever will result in the ineligibility for an exchange. 

(e) Original receipts and/or proof of purchase must be enclosed in the packaging for the return of the Product to HPlus. 

(f) Complaints that the Product purchased do not perform according to the Customer’s  expectations or purposes shall not be a valid reason for exchange, unless the Product wholly and completely fails to perform according to representation and descriptions provided by HPlus, or fails to perform in accordance with the intended purposes which the Product were manufactured for.

(g) Defects or any abnormalities of the Product due to defective installation and/or improper care on the Customer’s part shall not be a ground for exchange.

(h) Upon the replacement of the Product, if the Customer requires the services of HPlus on the installation and assemble of the Product or the Product requires additional accessory or the fixing of the exhaustible parts, such costs and expenses in relation thereto shall be borne by the Customer. 

7.6  When necessary or requested by HPlus, the Customer shall provide pictures of damaged or defective Product or any part thereof to HPlus for inspection purposes.

7.7  Shipping fees and/or any handling cost incurred by Customer for the return, exchange or self-collection of the Product shall be borne by the Customer.

7.8  The Clause herein shall only apply for Product purchased from HPlus, its Authorised Dealer or Official Website.

8. REFUND

8.1  Refund is strictly not allowed upon full purchase price is paid to HPlus.

9. MISCELLANEOUS

HPlus may offer specific promotion and/or programme in relation to the sale and purchase of the Product from time to time and the terms and conditions contained in any addendum / specific promotion / programme in relation to the sale and purchase of the Product shall form part of this Agreement and shall be taken read and construed as an essential part of this Agreement.  In the event of any conflict or inconsistency between the terms and conditions contained herein above and those contained in the addendum / specific promotion / programme the terms and conditions contained in the addendum / specific promotion / programme shall prevail.

10. WARRANTY 

10.1  The Warranty of the Product shall be covered in accordance with the terms and conditions set forth by IRHydrolife. Please click here to read the Warranty.

10.2  HPlus may at its sole discretion extend the Warranty period for the CORE PART ONLY for a further term of three (3) years upon the expiration of twenty four (24) months as provided by IRHydrolife subject that the same terms and conditions set forth by IRHydrolife shall apply.

10.3  The Warranty abovementioned applies only to purchases made directly from HPlus, our Authorised Dealer and/or our Official Website only.

10.4  The delivery order must be completed with machine serial number, Customer particulars (Customer name, NRIC number, address and contact numbers) and signed by Customer with date of receipt. The complete delivery order, acknowledged and signed by Customer with date of receipt shall be returned to us within seven (7) days from the date of receipt.

10.5  The Customer is required to provide the machine serial number and his/her particulars for warranty claims

10.6  In the event of any dispute, discrepancy, warranty claim or query arises, the Customer shall deal the matter directly with IRHydrolife. HPlus may assist the Customer however all costs and expenses incurred including but not limited to administrative charges imposed by HPlus shall be borne by the Customer.

10.7  In furtherance, the Customer hereby agrees as follows:-

(a) The Warranty is not transferable.

(b) The Warranty does not include the cost directly or indirectly resulting from the transportation, delivery and incidental cost incurred in fulfilment of this Warranty. The Customer shall be fully responsible for the cost of delivery of the Product for any repair work to HPlus or IRHydrolife and for the subsequent collection. Any Product to be repaired must be delivered and/or returned to HPlus or IRHydrolife at the Customer’s own cost and expenses.

(c) To the fullest extent permitted by law, HPlus shall not be in any way liable for any consequential, incidental, direct, indirect damages whatsoever arising from or in connection with the use, inability to use or performance of the Product, including without limitation loss of reputation, failure to realise savings or other benefits, loss of use of the Product, loss of/or damage to other property due to the malfunction of the Product, costs of substitute equipment, loss due to downtime cost, costs of recovering. HPlus does not exclude or limit liability for personal injury or death.

(d) Without limiting the generality of the foregoing, the Customer assumes all risk and liability for loss, damage or injury to the Customer and their property and to any third parties arising out of the use, misuse or inability to use the Product.

(e) In the event that the Product is out of stock, HPlus reserves all rights to replace the Product with another Product of similar value as deem appropriate, subject to availability. In no event shall any recovery against HPlus exceed the actual price paid for the purchase of the Product.

(f) HPlus reserves all rights to impose charges for services on the Product which are outside the perimeter of warranty coverage. HPlus also reserves the right to decline Product servicing where the Product is obsolete, no longer deemed serviceable or replaceable for any reason.

(g) HPlus reserves the right to charge the Customer separately for (a) any parts required to repair the Product; or (b) replacement of the Product, due to loss or damage arising out of improper use of the Product or unauthorized services performed on the Product.

(h) The Customer shall allow HPlus to conduct regular maintenance as provided for under HPlus and/or IRHydrolife’s maintenance policy. Frequent postponement or cancellation of maintenance appointments of more than 3 times will be viewed as a breach of this terms and conditions herein.

10.8  Upon receipt of the Product by the Customer, the Customer will be deemed to have accepted the Product in a satisfactory condition and the installation of the Product has been performed to Customer’s satisfaction.

10.9  All decisions by HPlus on complaints, defects, workmanship and/or material shall be final and conclusive.

10.10  With the proceeding of the Product usage, it means the Customer has read, understood and agreed on the HPlus and/or IRHydrolife’s warranty terms and conditions and also acknowledged that HPlus and/or IRHydrolife’s limitations of liability are reasonable and within the context and circumstances under which it is applied on.

10.11  HPlus and/or IRHydrolife reserves the right to amend and/or modify the terms and conditions of the Warranty without prior notice. 

11. NOTICES

11.1 Any notice required or permitted to be given by either party to the other shall be in writing and addressed, if to HPlus, to its registered office or principal place of business, and if to Customer, to the correspondence address and/or the email address stipulated in the Account and/or the Order.

11.2 A notice by way of writing shall be deemed sufficient, if it is performed electronically, such as through email or any other electronic means of communication. 

12. APPLICABLE LAW AND JURISDICTION

12.1  This Agreement shall be interpreted and governed by the laws of Malaysia. 

12.2. Any controversy, claim or dispute arising out of or relating to this Agreement and/or any transactions made in this Site or with other parties therein will be referred to and adjudicated through a court of competent jurisdiction in Malaysia.

13. ACKNOWLEDGMENT

13.1  By placing an Order with HPlus for the purchase of the Product, the Customer hereby agrees accepts and understands the terms and conditions herein contained.
